Primary Responsibilities
Among other in-house activities, the candidate will monitor and manage a portfolio of delinquent and/or distressed credits through proactive legal management and restructuring efforts. This includes:

Primary Responsibilities
Among other in-house activities, the candidate will monitor and manage a portfolio of delinquent and/or distressed credits through proactive legal management and restructuring efforts. This includes:
- Prepare amendments, payment plans, waivers, legal notices, demands, acceleration, and other equivalent documents
- Prepare and present periodic reports to management
- Liaise with the other departments at Marco to provide day-to-day leadership and advice in relation to financing workouts, pursuit of legal action, collections, litigation, defaulted assets
- Manage relationships with external counsel, including providing strategic instructions and tracking associated costs
- Pro-actively escalate legal risks
- Prepare materials for regulator examinations, external and internal audits
- Conduct legal research on transactional and regulatory and compliance matters
- Provide or assist in the preparation of strategic advice on legal, compliance and regulatory issues affecting the company's business lines, including advising on regulatory frameworks
- Be the primary point of contact for all regulatory and compliance matters relevant to the company's business activities
- Oversee and work with outside counsel in the establishment of appropriate licenses, authorizations, policies, and procedures necessary to meet all regulatory and compliance requirements for the company's actual or proposed business activities, and manage the ongoing monitoring of such requirements
- Monitor active business activities to anticipate, flag and mitigate potential risks
- Assist in audits, investigations or litigation and prepare audits by developing strategies, maintaining records and designing procedures, and review, assess and respond to regulatory and compliance inquiries
- Design, prepare, review, and monitor company policies, manuals, and practices on regular basis to ensure compliance with applicable regulations
- Help develop Marco's internal legal department by defining and refining work processes, and creating and adjusting precedents which will serve as the basis for all transactions
- Help draft, review, and negotiate a wide range of complex legal agreements that support and enable our business operations mainly in the U.S. and Latin America
- Qualified to practice law in a relevant U.S. or Latin American jurisdiction
- 3+ years of experience within a corporate law practice in a law firm or relevant in-house experience in a FinTech or start-up
- Self-motivated and proactive approach to managing relationships and projects
- Detail-oriented with exemplary attention to detail
- Sound business judgment and adaptability to manage multiple wide-ranging matters and conflicting deadlines
- Ability to work comfortably in fast-paced environments, collaboratively and cross-functionally
- Outstanding verbal and written communication skills. Fluency in written and verbal Spanish and English is a must
- Excellent interpersonal skills with an ability to provide sound, clear legal advice to senior executives and other senior leaders
- Experience in regulatory and compliance matters related to the cross-border financing industry is a strong plus
- Experience in drafting, negotiating, and advising on commercial, financing, and related agreements is a strong plus
